Terms & Conditions

By booking a shoot with the Photographer, Diana Stainton, you agree to the terms & conditions below.

Usage
The images the Photographer supplies are for the sole use of the Client only. The images may not be used by another company for advertising purposes without full credit. The images must not be sold on for profit.
Permission to use the images for purposes outside the terms stated above will be granted for an additional fee.

Bookings
Booking are for one brand, unless otherwise agreed.

Copyright
The copyright of all photography remains with the Photographer for every shoot.
The Client assigns to the Photographer the irrevocable and unrestricted right to use and publish photographs for editorial, advertising, educational and any other purpose for promotional purposes of the Photographer.

Files
The Photographer will supply srgb high resolution and web sized jpegs. The Photographer will supply Tiffs on request. Raw files are not supplied.

Delivery
The cost of delivery and returns is the responsibility of the Client. In the (unlikely) event that products go missing in transit, it is the responsibility of the Client to claim responsibility with the courier.

Products
If you are waiting for a first run of samples to be made, please allow a buffer to allow for delays in production or amendments of incorrect samples, especially if samples are coming from abroad. I would suggest booking a photoshoot 2 weeks after samples are due to arrive. Please pack products well, with sufficient packaging/bubblewrap to protect each item.
The products sent must be in good condition, clean and quality controlled by the client prior to the photoshoot. The Photographer is not responsible for incorrect or damaged samples.

Colourways
Each colour way counts as one product. e.g if you have 5 products in 5 colourways this is 25 products.

Cutouts
Cutouts are supplied on a white background, as a jpeg. Clipping paths are supplied on request.

Deposit / Cancellation
A 50% deposit is taken to secure the booking date. This covers admin time and studio running costs. Deposits are non-refundable in the event of cancellation as it covers loss of income. 2 weeks notice is required to move a booking date, (not applicable for mini shoots, where the date is set). If you need to change the shoot date with less than 2 weeks notice, I have a £50 admin fee.

Please ensure products are ready at least two weeks prior to the shoot and leave extra time if you have not seen samples in case amendments need to be made or there are manufacturing delays. If posting, please send the products one week prior to the shoot.

If the Photographer has to cancel this contract for reasons beyond the Photographer’s control (e.g. death, injury, sickness, etc.), a full refund will be granted.

Delays
Please arrive promptly for your photoshoot slot and allow extra time in case of traffic. If you arrive late for your time slot, unfortunately I will not be able to add extra time onto the end of the shoot.

Amendments / extra image processing
Amendments can be made upon request. I include one hour processing time in my fee for product shots. If there are a lot of images to process, advanced retouching or amendments after the files are delivered, the fee is £40ph.

Style
You are booking me, Diana Stainton, on the basis that you like my style of photography. I have a range of examples on my website of the kind of work I can produce. If you don’t see a style you like, I’m most likely not the best match for you. I say this as I want businesses to be successful and get what they need from a photoshoot. After I have received a moodboard, I will light and style images with my own spin on it. I do not offer refunds if the images are rejected on the basis of style, composition or lighting style. I will however, try my best to resolve any issues on the day of the shoot. If you grant me creative freedom, no refunds will be given on basis of style.

Turnaround
My typical turnaround time is one week / 7 days from the photoshoot date.

Selection
I do not supply all images taken on a photoshoot. For product shoots, we style to the crop needed and select the best / final shot of the scene as we shoot. Model shoots are faster paced so I send a contact sheet of images to be selected by the Client.
